  • One Day Outreach Program on Facilitating Innovation and Patent Filing (29th February 2016)

DSCN9548The program was jointly organized by IUCIPRS, CUSAT  and MHRD Chair on IPR, CUSAT hosted by International and Inter University Centre for Nanoscience and Nanotechnology, MG University, Kottayam.  Dr. Babu Sebastian, Hon’ble Vice Chancellor, M G University delivered the keynote address. Prof. Dr. N S Gopalakrishnan, Director (IUCIPRS) & Chair Professor (MHRD Chair on IPR); and Dr. I G Rathish, Assistant Professor, IUCIPRS, CUSAT were the resource persons.  Technical sessions of this workshop were to evaluate the innovation     activities at the Mahathma Gandhi University and explore the possibility of using patent to promote innovation.

The scope of protection of a patent is confined to what is claimed. Patent specifications are techno-legal documents which describe the technological invention and demarcate the legal limits of the intellectual property. As unilateral declarations of the patentee, patent specifications have been subjected to special principles of interpretation. Interpreting patents exposes the challenges in technology and law. Surprisingly, the patentee who seeks to expand the scope of the claim in an infringement suit would also seek to narrow the scope of same invention in proceedings where the validity of the patent is challenged. Given this predicament, courts have evolved principles on interpreting patents and constructing claims.

The Inter University Centre and MHRD Chair had jointly organized a workshop on Patent Claim Construction on 14th November 2015. The key speakers of the workshop were Prof. Feroz Ali Khader, MHRD Chair Professor, IIT Madras and Prof. (Dr.) N.S. Gopalakrishnan MHRD Chair Professor, CUSAT and Director, IUCIPRS.

The workshop was intended for the law students and faculties in Kerala who are familiar with Patent Laws. There were thirty eight participants, faculties as well as students, from various disciplines including law, engineering and biotechnology.

The workshop was divided into three sessions. Started at 9.00 am, the first session continued till 11.00 am and during this session, there was a discussion on Principles of Patent law, A Brief Account on the Evolution of Patent Specifications, How a Patent is Granted, How a Patent is enforced. At 11.00 am we took a break for 10 minutes and the Second session themes were How to Read a Patent Specification along with various examples, the relevant provisions in the Acts and the Rules on Interpretation. The lunch break was for an hour at 1.00 pm.

The post lunch session dealt with interpretation of claims, the different methods of interpretation adopted by different patent offices in different jurisdictions and also the different rules of interpretation evolved by different courts. The session ended at 4.00 pm.
